By accessing or using FeedMail (“we”, “our”, “us”, or the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms apply to all users, including owners, managers, and customers providing feedback.
2. Description of Service
Our Service provides a feedback collection and analytics platform for businesses. You can create an organization, manage branches, collect feedback from customers, and analyze results through our dashboard. We may improve, update, or modify the Service at any time, with or without notice.
3. Eligibility
To use the Service, you must be at least 18 years old and have the authority to bind your organization to these Terms. You are responsible for all actions taken under your account credentials.
4. Account Registration
You must provide accurate, complete information when creating an account and keep your information up to date. You are responsible for safeguarding your password and all activities under your account. We are not liable for any loss or damage resulting from unauthorized use of your account.
5. Payments and Subscriptions
Certain features of the Service require a paid subscription. Payments are processed securely through Paystack. All prices and billing periods are displayed before checkout.
- All fees are non-refundable unless required by law.
- If a subscription renews automatically, you authorize recurring billing until you cancel.
- You may cancel anytime; your plan will remain active until the end of the current billing period.
- We reserve the right to change prices, features, or billing structure with prior notice.
6. Use of Service
You agree to use the Service only for lawful business purposes and in compliance with all applicable laws. You may not:
- Resell, sublicense, or exploit the Service commercially.
- Upload or distribute malicious software, spam, or harmful content.
- Collect or store personal data from customers without their consent.
- Reverse-engineer, decompile, or attempt to extract the Service’s source code.
7. Intellectual Property
All intellectual property rights in the Service and its content belong to FeedMail or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain ownership of the data you upload, but grant us a license to store, process, and analyze it to provide the Service.
8. Data and Privacy
Our collection and use of personal data are governed by our Privacy Policy. By using the Service, you consent to our data practices described there.
9. Termination
We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in activity that may harm our platform or reputation. Upon termination, all licenses granted under these Terms will immediately end.
10. Disclaimer of Warranties
The Service is provided on an “as-is” and “as-available” basis without warranties of any kind. We do not guarantee uninterrupted or error-free operation. You use the Service at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, FeedMail and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of the Service.
Our total liability for any claim shall not exceed the amount paid by you to us during the three (3) months preceding the claim.
12. Indemnification
You agree to defend, indemnify, and hold harmless FeedMail and its affiliates from any claims, damages, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.
13. Changes to Terms
We may modify these Terms at any time. Updated versions will be posted on this page and become effective upon posting. Continued use of the Service after changes means you accept the new Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Ghana (or your company’s jurisdiction), without regard to its conflict of laws principles.
